This document is a proposed replacement policy. Publish only after confirming that the statements accurately reflect MomYom’s operations, data flows, and SMS opt-in implementation.

1. Introduction and scope

MomYom (“MomYom,” “we,” “our,” or “us”) operates https://momyom.us and related digital storefronts, customer-support channels, products, and services (collectively, the “Services”). Our store is powered by Shopify. This Privacy Policy explains how we collect, use, disclose, store, and protect personal information when you browse our website, purchase products, request services, create an account, or communicate with us.

This Policy applies to personal information handled by MomYom in connection with the Services. Other platforms you visit through external links operate under their own privacy practices. Where another MomYom document conflicts with this Policy on personal information processing, this Policy governs that subject, except where applicable law requires otherwise.

2. Information we collect

Depending on how you interact with us, we may collect the following categories:

·       Identification and contact details: name, email address, telephone number, billing and delivery address.

·       Purchase and service information: items or services ordered, cart and wishlist activity, order history, payment status, shipping, delivery, exchanges, returns, refunds, appointments or service requests where applicable.

·       Account information: login credentials or account identifiers, preferences and account settings.

·       Payment and transaction information: payment method, transaction identifiers, billing data and limited payment details received from payment processors. Full payment-card details may be collected and processed by our payment providers, rather than stored by us.

·       Communications: requests, messages, reviews, customer-support interactions and attachments you submit.

·       Technical and usage information: IP address, device and browser details, cookies, page activity, approximate location derived from IP address, and other identifiers.

·       SMS program records: mobile number, the date and method of opt-in, the disclosure presented, consent status, delivery/opt-out events and support communications.

3. Sources of information

We collect information directly from you; automatically through your use of our Services and cookies; from Shopify, payment processors, shipping and fulfillment vendors, and other contracted service providers; and, where permitted, business partners or third-party sources. We do not purchase phone-number lists for our SMS messaging program.

4. How we use personal information

We use personal information as reasonably necessary to:

·       Operate and improve our online store and services; maintain customer accounts; provide products or requested services.

·       Process payments and transactions, fulfill and deliver orders, and coordinate returns, exchanges, refunds and service appointments where offered.

·       Respond to customer support inquiries and send important service, order, account and delivery notices.

·       Protect our website, customers and business against fraud, abuse and unauthorized activity.

·       Understand website usage and improve functionality, user experience, product selection and service quality.

·       Conduct advertising or send optional promotional communications where authorized and permitted by applicable law, subject to your choices.

·       Comply with legal obligations, resolve disputes and enforce applicable terms.

5. Cookies, analytics, and personalized advertising

We and our technology partners may use cookies and similar technologies to operate the site, remember preferences, measure traffic and performance, and support advertising when enabled. Cookies and data sharing for targeted advertising are subject to applicable law and available choices. 6. When we disclose information

We may disclose personal information to Shopify and providers acting for us, such as payment processors, hosting and IT providers, shipping companies, order fulfillment vendors, support vendors, security and analytics providers, and professional advisers as needed to perform their functions.

Where permitted by law and subject to applicable choice controls, we may disclose certain non-SMS personal information to advertising or business partners for marketing, personalized advertising, and analytics. We may also disclose information at your direction (for example, to fulfill a requested delivery), within our corporate group, in a legitimate business transaction, or as reasonably necessary to comply with law, legal process, and protection of rights.

IMPORTANT SMS EXCEPTION: Every general disclosure permission in this section, including disclosures requested or consented to by a customer, excludes SMS opt-in information and SMS consent records from any third-party or affiliate marketing or promotional use. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All SMS opt-in data and consent are excluded from the above sharing categories for marketing purposes, even with consumer consent. We do not sell, rent, or transfer SMS messaging consent to another business for its independent marketing program.

Contracted SMS delivery providers may process phone numbers and message-related data strictly to provide messaging services on our behalf, subject to confidentiality and use limitations. This is operational processing, not authorization for the provider’s independent marketing use.

7. SMS/MMS communications and consent

MomYom may send customer-care and transactional SMS/MMS messages to individuals who have affirmatively agreed to receive them. Messages may include order confirmations, delivery and shipping notifications, service-request or appointment updates where applicable, account notices, returns or refund updates, and responses to customer-support inquiries.

Where MomYom collects consent using an online form, consent must be obtained through an optional, separate, unchecked SMS checkbox with a clear disclosure. An individual may also initiate a messaging conversation by texting MomYom, in which case we respond within the scope of that conversation and applicable rules. Providing a phone number alone, or agreeing to general Terms, is not a substitute for express SMS opt-in where required.

Message frequency varies with purchases and support activity. Message and data rates may apply. To stop receiving SMS messages, reply STOP. For assistance, reply HELP or contact support@momyom.us. A final opt-out confirmation may be sent. SMS consent is optional and is not a condition of purchasing any product or service.

Consent to transactional/customer-support SMS does not authorize promotional or marketing SMS. Any separate promotional SMS messaging, if offered, will require an appropriate separate consent and applicable disclosures. We honor opt-outs in accordance with applicable rules.

No mobile information is shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent are not shared with third parties or affiliates for marketing purposes, even with consumer consent. The SMS restrictions in this section control over any general consent-based disclosure permission elsewhere in this Policy.

8. Marketing preferences and communications

You may unsubscribe from marketing emails using the unsubscribe link within those emails. For SMS, reply STOP to opt out or HELP for assistance. Opting out of marketing emails does not necessarily prevent lawful non-promotional account notices. SMS preferences are managed separately from email preferences.

9. Data retention and security

We retain information for as long as reasonably necessary for the purposes described in this Policy, such as servicing accounts, processing transactions, honoring opt-outs, complying with recordkeeping requirements, protecting the business and resolving disputes. Retention depends on data type, operational need and legal requirements. We may retain limited suppression records after an SMS opt-out so we can respect that choice.

We use reasonable organizational, technical and administrative protections designed to safeguard personal information. No electronic system or transmission method is completely secure. Please do not send sensitive payment or identity information through ordinary SMS or unprotected support channels.

10. Your privacy choices and rights

Depending on your location and applicable law, you may have rights to access, correct, delete, receive a copy of, or restrict certain uses of your personal information, including options relating to targeted advertising. Some rights are subject to exceptions. We may need to verify requests before responding.

11. Children’s privacy

A parent or guardian who believes a child has provided information may contact us to request review and deletion, subject to legal requirements.

12. International processing

Because our providers may operate internationally, information may be stored or processed outside your state or country. Where required, we use appropriate legal safeguards for cross-border transfers.
