This document is a proposed replacement policy. Publish only after confirming that the statements accurately reflect MomYom’s operations, data flows, and SMS opt-in implementation.

1. Overview and agreement

These Terms of Service (“Terms”) govern your access to and use of https://momyom.us, our storefront, related content, and the products and services made available by MomYom (“MomYom,” “we,” “us,” “our”). By accessing or using the website, creating an account, or placing an order, you agree to these Terms and any policies referenced here, to the extent permitted by law. If you do not agree, do not use the Services.

Our storefront may be hosted or powered by Shopify. Shopify provides technology infrastructure but your purchase or service arrangement is generally with MomYom, unless clearly stated otherwise.

2. Eligibility and customer accounts

You represent that you are of the age of majority in your jurisdiction or otherwise have the legal capacity and required permission to enter into these Terms. You agree to provide accurate information, maintain the confidentiality of any account credentials and notify us of suspected unauthorized use. You are responsible for activity through your account to the extent permitted by law.

3. Products, services and availability

MomYom may offer physical products, digital or other services, and related support. Offerings, descriptions, specifications, eligibility, geographic availability and pricing may change without notice. We try to display information accurately but cannot guarantee that photographs, colors, descriptions, stock levels or other content are free from errors. A listing does not guarantee availability or constitute an unconditional offer.

Any specific service scope, schedules, milestones, deliverables, cancellation or completion terms stated on a service page, quote, invoice or separate written agreement supplement these Terms. If a separately signed agreement expressly conflicts with these Terms for a particular service, that agreement controls for that service.

4. Orders, acceptance and fulfillment

Submitting an order is an offer to purchase, not an automatic acceptance. We may reject or cancel an order before fulfillment for legitimate reasons including unavailability, suspected fraud, payment issues, listing errors, or legal restrictions, subject to applicable law. Order confirmation acknowledges receipt; a separate shipment, service acceptance or fulfillment confirmation may establish acceptance where permitted. We may contact you if clarification is needed.

You must provide accurate billing, shipping and contact details. We are not responsible for delays or delivery failures caused by incomplete or inaccurate information you supplied.

5. Prices, payment and taxes

Prices are displayed in the currency shown at checkout and may change until an order is accepted. Applicable taxes, shipping fees, duties and other charges will be identified at checkout where required. Payment is processed through supported third-party payment providers, whose separate terms and privacy practices may apply. You authorize payment of the final amount displayed and approved at checkout.

In the event of an obvious pricing or listing error, we may contact you to confirm a corrected amount or cancel the affected order and refund amounts collected, subject to law.

6. Shipping, delivery and risk

Shipping options, estimated delivery dates, availability, and charges are shown on applicable pages or at checkout. Delivery estimates are not guarantees unless expressly stated. Risk of loss and title transfer as required by applicable law and the shipping arrangement. For physical goods, inspect delivery promptly and report problems using our support contact details. 7. Returns, refunds and cancellations

9. SMS/MMS messaging terms and conditions

MomYom operates a customer care and transactional text messaging program for customers who have affirmatively opted in. Messages may include order confirmations, shipping or delivery notifications, customer-support replies, account/service notifications, and appointment or scheduling updates if applicable.

You enroll by taking an affirmative action such as selecting an optional, unchecked SMS consent checkbox with the required disclosure on our website. Individuals who initiate a text-message conversation may receive direct responses relevant to that conversation, subject to applicable law. Consent is not a condition of purchase.

Message frequency varies depending on your account, orders or service inquiries. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages to the extent allowed by applicable rules. Message delivery is not guaranteed.

Opt out at any time by replying STOP to a MomYom SMS message. You may receive one confirmation text acknowledging your opt-out. This customer care/transactional SMS program does not include unsolicited promotional texts. Any separate marketing SMS program will have its own consent and disclosure requirements.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All SMS opt-in data and consent are excluded from sharing with third parties or affiliates for marketing purposes, even with consumer consent. 10. Prohibited uses

You may not use the website to violate the law, infringe intellectual-property or privacy rights, distribute malware, interfere with security or operation, scrape or access non-public systems without permission, submit fraudulent orders, impersonate others, or harass users or staff. We may restrict access for material violations, subject to applicable law.

11. Content and intellectual property

The website’s branding, text, design, photography, graphics, software and other materials are owned by MomYom or its licensors and protected by applicable laws. You receive a limited, revocable, non-exclusive license to use the website for legitimate personal or business browsing and shopping. You may not reproduce, redistribute or commercially exploit materials without permission, except as permitted by law.

12. Feedback, reviews and user submissions

If you submit a review, suggestion or other content, you represent that you have the right to submit it and that it is accurate to the best of your knowledge and does not violate another person’s rights. You grant MomYom a non-exclusive, worldwide, royalty-free license to host, display and use that submission to operate and promote the Services, subject to applicable law and our Privacy Policy. We may remove unlawful or otherwise prohibited content.

The website may link to or integrate with independently operated services, including payment processors, shipping providers and social platforms. We do not control and are not responsible for independent third-party content or practices. Your dealings with those services may be governed by their terms.

Any limits on direct damages apply only to the extent permitted by applicable law; they do not exclude liability that cannot legally be limited, including liability arising from fraud, willful misconduct or other non-excludable obligations.

To the extent permitted by applicable law, you agree to reimburse MomYom for reasonable third-party losses and costs arising from your unlawful use of the Services or material breach of these Terms, except to the extent caused by MomYom’s own conduct.

18. Termination and severability

We may suspend or terminate website access for violations of these Terms, suspected fraud or risks to our Services, subject to applicable law. Rights or obligations intended to survive termination will survive. If a provision is held unenforceable, the remaining provisions continue to the extent possible. Failure to enforce a provision does not waive it.

19. Governing law and disputes
